Please read these terms and conditions carefully and make sure you understand the contents before placing your order with us. By using our website and online shop you are agreeing to these terms.

These terms and conditions do not affect your statutory rights as a consumer.

How to order

All orders must be placed online through the website using the shopping basket facility provided.

Please do not e-mail your card details. No responsibility can be taken for the security of your details if given this way.

Placing your Order

By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with or unclear about any aspect of these terms, please contact us on 0115 925 4080, by email at contactus@ghhurt.com or by post at the address given below.

By placing an order with us via this website you are making an offer to G.H.Hurt & Son to purchase the goods detailed in your order under the terms described in your order.

Once you have placed an order we will send you a confirmation that your order has been received but this is not a confirmation that your offer to purchase the goods has been accepted. A contract between you and G.H.Hurt & Son for the sale of our products will only exist once we dispatch your order to you and send an e-mail confirmation to you that we've dispatched the goods.  This does not affect your statutory
rights.

It is your responsibility to ensure you are able to receive e-mails from the G.H.Hurt & Son Shop. We recommend you add contactus@ghhurt.com and orders@ghhurt.com to your "safe sender" list, and check that your online security software does not block e-mails from us.

Goods Information

G.H.Hurt & Son work to ensure that information about the goods on the website is correct, actual packaging and materials may contain more and different information to that displayed on the website. All information about the goods on the website is provided for information purposes only. We recommend that you do not rely solely on the information presented on the website. Please always read labels, warnings and directions provided with the goods before use.

G.H.Hurt & Son reserve the right to amend the descriptions of the goods on the website, as required.

Pricing and availability

Prices and availability are subject to change without notice.

All products on our website should be available. If however due to high demand or an error one of our products is out of stock or unavailable we will endeavour to contact you to arrange a refund or alternative delivery date.

Prices are quoted in GBP sterling including VAT at the prevailing rate. You will be responsible for any customs duties or importation tax that may be due at the country of destination.

In the event a product is listed at an incorrect price due to typographical error we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to the purchaser's credit card account in the value of the incorrect price.

Every item is described as accurately as possible. If a pricing error occurs for a reason beyond our reasonable control e.g. alterations to the rate of value added tax, we will advise you accordingly.

Method of payment

You can pay either by VISA, MasterCard, Maestro, VISA Electron or PayPal Express. We are unable to accept cheques, cash or postal orders through our website. Orders will only be processed if you provide the card holder's name as it is shown on the card together with the postcode that appears on the card statement. No responsibility can be taken by G.H.Hurt & Son for incorrect or incomplete details submitted on the website.

Right of Refusal

If your card issuer rejects payment for your order goods will not be dispatched to you. We reserve the right to decline any order and in all such cases a full refund of any payment made will be refunded directly to the purchasing cardholder's card.

Card fraud is illegal and perpetrators will be prosecuted.

Delivery

UK Standard Delivery

£5.50 per order or FREE with orders over £150.

Please allow 3 to 5 working days for delivery from date of despatch.

Deliveries may require a signature, so you may wish to specify a secure delivery address where somebody will be available to sign.

We offer an express service if required at an additional cost, please email or telephone us for further details. Please help our delivery company and us by taking extra care with the address details.

Deliveries to more remote areas of the UK, such as the Highlands and Islands, Channel Isles, Isle of Man, Northern Ireland, Eire and the Scilly Isles etc. may be made by Royal Mail or Parcel Post. Please allow 7 working days for delivery from date of despatch.

  • If you require any special delivery conditions, please advise.
  • If you have any questions about the delivery of your order, please contact us.
  • If you require a parcel to be left in a safe place or delivered without a signature, this is at your own risk.

We take every care possible to ensure your goods reach you swiftly and in the best condition. However please note:

  • Shortages – It is your responsibility to sign for the correct number of packages as shown on the carrier’s delivery note and it will be your responsibility to notify us within 2 days from delivery.
  • Incorrect goods – It is your responsibility to notify us of any incorrect goods supplied within 2 days of delivery.
  • Time limitation for notification of claims – Damage in transit: If the goods arrive in a damaged condition you must make a note on the carriers’ delivery note and it will be your responsibility to inform us within 2 days of delivery.

We offer a delivery service to a wide range of international destinations. (Find your country in the drop down box provided at the checkout, or when you register.)

All prices on our website are in pounds sterling and are inclusive of vat. If your order is being delivered outside the United Kingdom (UK) your delivery may attract import duties and local sales taxes, which you will be responsible for paying on receipt of your parcel.  Please note we do not have control over these charges and cannot predict their amount. Duty and custom charges vary by country. Please allow 14 days for delivery from date of despatch.

USA Standard Delivery

Delivery charges to addresses in the USA is included in the cost of your order.

Please allow up to 14 working days for delivery from date of despatch.

Deliveries may require a signature, so you may wish to specify a secure delivery address where somebody will be available to sign.

We offer an express service if required at an additional cost, please email or telephone us for further details.

Please help our delivery company and us by taking extra care with the address details.

  • If you require any special delivery conditions, please advise.

  • If you require a parcel to be left in a safe place or delivered without a signature, this is at your own risk.

Returns and Cancellation policy

Under the Consumer Contacts (Information, Cancellation and Additional Charges) Regulations 2013 you have the right to cancel your order within 14 days of receiving your goods.

However this does not apply for personalised items: Due to the nature of personalised products, returns, changes or cancellations are not accepted once an order has been placed. (Please note: In order to offer an efficient delivery service your personalised order is sent to production immediately. Please check you have entered the name or initials on screen correctly as we are not liable for any customer errors.)

If you wish to cancel your order please call us on 0115 9254080 or email us at contactus@ghhurt.com as soon as possible, but at least within 14 days of receiving your goods.

If you cancel your order in full within 14 days of receiving your goods we will refund the full amount, including the initial standard postage and packing charges, in accordance with the Consummer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You will have to pay the costs of sending the item(s) back to us. We do not refund any postage charges if you cancel after the 14 days allowed, or if you only cancel part of your order.

You may also return your order to us if for any reason you are unhappy with your purchase, you can return it within 30 days of the date you received the goods. Items must be in the original packaging, with swing tickets and labels still attached, with its proof of purchase.

You must inform us of your intention to cancel or return your order by completing the "Order Cancellation Notification" form and returning it to us by email to contactus@ghhurt.com or send to the address below. Alternatively, you may call us on 0115 925 4080.

Please post the item(s) back to us at the address below.

The returned goods must be in new, unused and saleable condition with original labels and swing tickets attached. When returning your item, please wrap securely and enclose your order number and proof of purchase. G.H.Hurt & Son will refund the purchase price to you as soon as possible and, in any case, within 14 days of the receipt of the returned goods. The customer is responsible for the postage costs incurred when returning items.

Sadly we cannot be responsible for parcels that fail to reach us so we recommend you obtain a proof of postage from your post office by using Royal Mail Registered Post or similar.

Please note that if you fail to take reasonable care of the goods G.H.Hurt & Son reserves the right not to accept the return.

Conformity

We endeavour to ensure the accuracy of product descriptions, specifications and representations. However, these are subject to change and should not be considered binding. In particular, colours are subject to minor variation between dye lots and may look slightly different on your computer screen.

Complaints

We aim to deal with all complaints as effectively as possible. In the first instance, your complaint may be sent to G.H.Hurt & Son via email, contactus@ghhurt.com. Alternatively, you may telephone us on 0115 925 4080, between 9am and 5.00pm, Monday to Thursday, 9am and 3pm Friday.

We aim to acknowledge any complaint made through the website by email within 5 days, and to conclude our investigations as soon as possible thereafter. Telephone complaints will not necessarily be acknowledged by email prior to investigation. Our acknowledgement will always include the name of the person who is handling your case. A likely timescale for resolution will be provided upon request, but this timescale will be dependent upon the specific nature of the complaint.

Data protection and privacy

We respect your absolute right to privacy. Any details which you provide to us from which we can identify you are held and processed lawfully and in accordance with the Data Protection Act 1998. Because of this, any personal information that you give us will never be given or sold to any other organisation under any circumstance without your express permission.

G.H.Hurt & Son will use the information you give us to fulfil your order, contact you in case of fulfilment difficulties or to investigate complaints.

You may be asked whether you would like to opt in to receive further information from the G.H.Hurt & Son in the form of an email newsletter. This requires contact information such as name and email address to be retained by us for this purpose. If you do not wish to receive details of our new products or services simply send an email to contactus@ghhurt.com at any time.

Delivery times can be affected due to packages being inspected by customs.

Jurisdiction

The Courts of England and Wales shall have exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with this website and its use and these terms and conditions.
